License and Warranty Agreement for Previous issues of INSIGHT
Please be advised that by clicking the Accept button you are consenting to be bound and are becoming a party to this Agreement. This Agreement is applicable to e-mail of the previous volumes of INSIGHT. If you do not agree with all of the terms of this Agreement, click the Don’t Agree button and your credit card transaction will be terminated.
Part I - Contents of the previous issues of INSIGHT: You have reviewed the abstract version of the previous issues of INSIGHT and have found their content and form to be acceptable. Your computer system has a word processor that can open an *.rtf file and also has the capability to open images using either a *.gif or *jpeg. Your e-mail system needs a minimum of 2 megabytes of memory for receipt of the INSIGHTs.
Part II - Issues of INSIGHT: Upon receipt of the INSIGHTs you agree to the following
- use the INSIGHTs on any computer
- use the INSIGHT on a network
- make a copy of the INSIGHTs for archival purposes
- printout the INSIGHTs for your own personal use.
You may not
- modify, translate or create derivative works based on the content of these INSIGHTs
- copy the INSIGHTs other than as specified above
- rent, lease, grant a security interest in, or otherwise transfer rights to these INSIGHTs
Delivery of INSIGHTs: The INSIGHTs will be sent by e-mail via the address supplied by you during the next business day for Phase Technologies, Inc. as indicated by the current calendar.
III. Export Controls None of the INSIGHTs or underlying information may be sent or otherwise exported or reexported (a) into (or to a national or residence of) Cuba, Iraq, Libya, Sudan, North Korea, Iran, Syria or any other country to which the U.S. has embargoed goods; or (b) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or U.S. Commerce Department’s Table of Denial Orders. By receiving these INSIGHTs you are representing and warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list. In addition, you are responsible for complying with any local laws in your jurisdiction which may impact your right to import, export or use these INSIGHTs.
Limited Warranty Licensor warrants that for a ten (10) day period from the date of the transmission of the INSIGHTs the Licensor will replace any defective portion of the INSIGHTs that occurred as a result of the e-mail transmission or under the following terms and conditions (a) the replacement does not constitute a complete replacement of the INSIGHTs; (b), the replacement portions will be sent via e-mail transmission and the Licensor assumes no responsibility for failure to transmit any portion of the document as a result of rejection of the e-mail transmission by your ISP and (c) the Licensor reserves the right to reject replacement of any portion of the INSIGHTs it feels is unjustified. Under no circumstances will the Licensor refund the fees paid for e-mail of previous issues of INSIGHT.
